Anniversary of the Eastern Maar Native Title Determination
Anniversary tracker
28 March 2023
On 28 March 2023, the Federal Court recognised Eastern Maar native title over a large part of the claim area. The community marked the determination on Country at Logans Beach in Warrnambool.
Recognition on Eastern Maar Country
Eastern Maar Aboriginal Corporation’s own public notice identifies the date and distinguishes the area recognised in 2023 from other areas still requiring resolution at the time of that notice. The Victorian Government also records the on-Country hearing and recognition.
A milestone with a defined scope
The determination should not be described as resolving every parcel within Eastern Maar Country or every outstanding part of the application. Its boundaries and orders matter, just as the community’s relationship with Country extends beyond a short legal summary.
The anniversary can honour the work of Elders, families and applicants without suggesting the Court created their connection. Recognition is a significant legal event within a continuing history, not the beginning of Eastern Maar people or culture.
The outcome also offers an opportunity to learn about the places where schools, workplaces and visitors operate. Public access to a court record is not permission to reproduce cultural knowledge or enter places without appropriate guidance.
Reflecting and learning
Compare the determined area with the broader application described in the Corporation’s notice. Why is it important to state what an outcome covers as well as the achievement it represents?
Start with the sources below and distinguish the original event from later interpretations and commemorations. When using this date in a classroom or workplace, allow time for questions and further reading. First Nations peoples have diverse histories and perspectives; this brief introduction does not speak for every community.
