Anniversary of John Koowarta’s High Court Victory

Anniversary tracker

Date: 11 May 1982

The decision on this date

On 11 May 1982, the High Court delivered its decision in Koowarta v Bjelke-Petersen. The litigation arose from Queensland’s refusal to allow the proposed acquisition of Archer River pastoral lease for Aboriginal people, including Wik man John Koowarta.

The case tested the operation and constitutional validity of important provisions of the Commonwealth Racial Discrimination Act 1975. The Court upheld the relevant federal law, making the decision a landmark in the protection of Aboriginal people against racially discriminatory government action.

A person and community behind the case

John Koowarta’s campaign concerned a practical aspiration: the ability of Aboriginal people to acquire land. The case is therefore more than a constitutional-law footnote. It belongs within the wider history of Aboriginal people seeking to live on and exercise authority in relation to Country.

The judgment should not be described as a native title determination or as an immediate handback of the disputed land. It addressed the legal challenge before the Court, and the wider campaign continued beyond the delivery of the decision.

Why the anniversary matters

This date adds a Queensland story of persistence and legal achievement to the calendar. It also helps explain that the Racial Discrimination Act’s history includes people who used it to challenge specific barriers, rather than legislation operating independently of community action.

For schools and workplaces, distinguish the person’s objective, the government decision being challenged and the legal question the court answered. Those are related but different parts of the story. Compare the case with the separate anniversary of the Racial Discrimination Act’s commencement and consider why an enacted right can still require determined people to pursue its application. Historical learning should recognise Koowarta’s leadership and the community stakes, without suggesting the decision ended racial discrimination in Australia.
