Anniversary of the Native Title Act’s Commencement
Anniversary tracker
1 January 1994
The Native Title Act 1993 commenced operation on 1 January 1994. The anniversary marks the legislative framework developed after the Mabo decision, including processes for the recognition and protection of native title.
From Mabo to a national legislative framework
The National Native Title Tribunal distinguishes the Bill’s passage through the Senate on 21 December 1993, royal assent on 24 December and commencement on 1 January 1994. This calendar uses commencement, rather than labelling New Year’s Day as an event in 1993.
A framework with several purposes
The Act provided procedures for determining claims, dealing with acts affecting native title and addressing past acts. It should not be described as automatically returning every part of Aboriginal and Torres Strait Islander Country or granting the same rights to every community.
The Act’s commencement is different from the Mabo judgment and from each later determination. A timeline that separates them can show how a national legal principle became a statutory process and how communities then pursued particular claims.
The anniversary can recognise the advocacy and negotiation around reform while also examining the demands the process places on applicants. Legal recognition does not create a people’s identity or connection to Country. The existence of a claim or a negative legal outcome should not be used as a simple test of cultural belonging.
Reflecting and learning
Compare this milestone with one successful determination in the calendar. What did the legislation establish, and what still had to be decided for the particular claim?
Start with the sources below and distinguish the original event from later interpretations and commemorations. When using this date in a classroom or workplace, allow time for questions and further reading. First Nations peoples have diverse histories and perspectives; this brief introduction does not speak for every community.
