Anniversary of the NSW Aboriginal Land Rights Act’s Commencement

Anniversary tracker

Date: 10 June 1983

What the date marks

The Aboriginal Land Rights Act 1983 commenced in New South Wales on 10 June 1983. The date is identified in official archival records and is used by the NSW Aboriginal Land Council to mark the legislation’s anniversary.

This entry concerns commencement of the statutory framework. It should be distinguished from earlier parliamentary votes and from the founding of the NSW Aboriginal Land Council as a grassroots organisation in 1977. The Act gave the Council a statutory role within the new system.

Land rights and community institutions

The legislation established a framework for Aboriginal land councils and claims to certain Crown land. It created a means of recovering a land base and supporting Aboriginal community interests after generations of dispossession.

Statutory land rights in NSW are different from native title. Their legal foundations and processes are not interchangeable, even though both are part of the wider story of Aboriginal people pursuing recognition, ownership and responsibilities relating to Country.

Why this anniversary is important

This milestone recognises the advocacy and organising that preceded the law, as well as the work required to make land rights practical. A date on a calendar cannot capture every claim, community decision or continuing challenge, but it can provide a starting point for understanding the institutions involved.

For schools and workplaces, learn which Local Aboriginal Land Council operates in the relevant area and read its own account of its work. Traditional Owner groups, native title bodies and land councils can have different roles; avoid assuming one organisation speaks for every matter. Discuss why land is connected to culture, community wellbeing, economic opportunities and future generations. The anniversary celebrates an important framework while recognising that legislation alone does not complete the work of land justice.
