Anniversary of the Nyikina Mangala Native Title Determination

Anniversary tracker

Date: 29 May 2014

What happened on this date

On 29 May 2014, the Federal Court made the Nyikina Mangala native title determination in Western Australia. The decision is recorded as Watson on behalf of the Nyikina Mangala People v State of Western Australia (No 6), [2014] FCA 545.

This is the determination date, rather than the later administrative date when the decision was entered on the National Native Title Register. Keeping those dates separate helps ensure the anniversary marks the recognition itself.

A Kimberley land rights achievement

The determination followed a lengthy process of seeking legal recognition of continuing rights and interests in Country. Reports from the time described an on-Country hearing in the Fitzroy River region and the importance of the occasion to Traditional Owners.

Subsequent official native title records identify Walalakoo Aboriginal Corporation as the body holding the recognised rights and interests in trust. There have also been later determinations and variations; this entry specifically marks the 2014 decision, rather than treating every later change as part of the same date.

Country and legal recognition

Native title recognition acknowledges rights and interests arising from Aboriginal law and custom. The people’s connection with Country did not begin when the court made its order. An anniversary can celebrate persistence and recognition while keeping that much longer history at the centre.

For schools and workplaces, use this date to learn about the Kimberley beyond a general reference to Western Australia. Start with the names of the peoples involved and a map of the determination area from an authoritative source. Discuss the difference between a court acknowledging continuing rights and a government giving people a new cultural identity or connection. Community accounts should guide any deeper learning about Country and local priorities.
