Anniversary of South Australia’s Aboriginal Lands Trust Act

Anniversary tracker

Date: 8 December 1966

What happened on 8 December

On 8 December 1966, the Governor of South Australia assented to the Aboriginal Lands Trust Act. The legislation established a trust to hold land for the benefit of Aboriginal people, creating an important early statutory land rights framework in Australia.

The date here is the Act’s assent date. It does not mean that every Aboriginal reserve was transferred on that day, or that all Traditional Owners in South Australia received recognition of their Country through this one law.

Land, ownership and the limits of reform

The legislation provided a mechanism for land previously held as Aboriginal reserves to be vested in the Trust. It responded, in part, to the long failure to give practical effect to promises concerning Aboriginal interests in land made when South Australia was established.

The parliamentary process also exposed the limits of the reform. A proposal to transfer mining and mineral rights to the Trust was rejected in the Legislative Council. Recognising this distinction avoids presenting the Act as a complete settlement of Aboriginal rights.

An important South Australian story

This milestone belongs in a national calendar alongside the later Northern Territory land rights legislation and the different landholding arrangements developed elsewhere. Land rights did not begin with one national law, and each jurisdiction has its own history of community advocacy, political negotiation and unfinished business.

Schools and workplaces can use the anniversary to compare statutory land rights with native title, without treating them as the same system. A useful starting question is who holds and manages land under each arrangement. Keep the focus on Aboriginal people’s continuing relationships with Country, community decision-making and the practical importance of having a secure land base for future generations.
